1. About this policy

This Privacy Policy explains how SmartTerra Urban Water Management Private Limited ("SmartTerra", "we", "us" or "our") collects, uses, shares and protects personal data when you visit www.smartterra.io (the "Website") or contact us through it.

SmartTerra is a company incorporated in India with its registered office at Flat No. 1402, Block I, Watermark, Kasavanahalli, Varthur Hobli, Bengaluru 560035, Karnataka, India. For the personal data described in this policy, SmartTerra is the Data Fiduciary under India's Digital Personal Data Protection Act, 2023 (the "DPDP Act") and, where applicable, the data controller under other data protection laws.

This policy applies only to the Website. It does not apply to SmartTerra's software products or client engagements, which are governed by separate agreements.

2. Information we collect

We collect only the personal data needed to run the Website and respond to enquiries.

  • Information you give us. When you use the contact form, we collect your first name, last name, email address and the content of your message. When you email or call us, we collect your name, contact details and anything you choose to tell us, such as your organisation and job title.

  • Information collected automatically. When you visit the Website, our hosting provider and embedded services collect technical data such as your IP address, browser type, device type, operating system, referring page, pages viewed, approximate location derived from your IP address, and the date and time of your visit.

We do not ask for sensitive information through the Website. Please do not include it in messages you send us.

3. How we use your information

  • Responding to enquiries and following up on business discussions. Data used: contact form and correspondence data. Basis: you provide the data voluntarily for this purpose, and we have a legitimate interest in responding to business enquiries.

  • Operating, maintaining and securing the Website, including preventing spam and abuse. Data used: technical data. Basis: legitimate uses permitted by law, and our legitimate interest in a secure, working Website.

  • Understanding how the Website is used, in aggregate, so we can improve it. Data used: technical data and analytics cookies. Basis: your consent where required by law; otherwise our legitimate interest.

  • Complying with legal obligations and responding to lawful requests. Data used: any of the above, as required. Basis: legal obligation.

We do not sell personal data. We do not use it for automated decision-making that produces legal or similarly significant effects. We will not use it for a purpose unrelated to those above without telling you first and, where required, obtaining your consent.

4. Cookies and similar technologies

The Website uses cookies and similar technologies in three ways:

  • Essential cookies, set by our hosting provider, Squarespace, to deliver the Website securely and keep it working.

  • Analytics cookies, set by Squarespace, to measure visits and page views in aggregate.

  • Third-party services embedded in the Website, such as Google reCAPTCHA (which protects the contact form from spam) and Adobe Fonts (which serves the Website's fonts). These services receive technical data such as your IP address and are governed by their providers' own privacy policies.

We do not use advertising or cross-site tracking cookies. You can block or delete cookies through your browser settings. Blocking essential cookies may affect how the Website works, and blocking reCAPTCHA will prevent the contact form from being submitted. 5. How we share your information

We share personal data only with service providers that process it on our behalf, under contracts that require them to protect it and use it only for the services they provide to us:

  • Squarespace: Website hosting, contact form processing and Website analytics.

  • Google (Google Workspace): email, document storage and internal collaboration, including handling of enquiries.

  • Google (reCAPTCHA): spam and abuse protection on the contact form.

  • Adobe (Adobe Fonts): delivery of Website fonts.

We may also disclose personal data where required by law, court order or a lawful request from a government authority; to protect the rights, property or safety of SmartTerra or others; or to a successor entity in connection with a merger, acquisition or sale of assets, subject to this policy.

6. International transfers

SmartTerra is based in India. Our service providers operate globally, so personal data collected through the Website may be stored or processed outside India, including in the United States. We transfer personal data only as permitted under the DPDP Act and other applicable laws. Where the law of your country requires it, we rely on appropriate safeguards offered by our providers, such as standard contractual clauses.

7. How long we keep your information

We keep personal data only for as long as needed for the purposes in this policy, and then delete or anonymise it.

  • Contact form submissions and enquiry correspondence: 12 months from our last interaction with you, unless the enquiry leads to a business relationship.

  • Correspondence forming part of a business relationship: for the duration of the relationship and as long as required afterwards under applicable law, such as tax and company law.

  • Website analytics data: 12 months, in aggregate form where possible.

  • Technical and security logs: 12 months, or longer where needed to investigate a security incident.

You can ask us to delete your data earlier, as described in section 9.

8. How we protect your information

We use reasonable security safeguards to protect personal data against unauthorised access, loss, misuse or alteration. These include encrypted connections (HTTPS) across the Website, access to personal data limited to personnel who need it, and two-factor authentication on the accounts that hold it.

No method of transmission or storage is completely secure. If a personal data breach occurs, we will notify affected individuals and the Data Protection Board of India, and any other authority, as required by applicable law.

9. Your rights

Subject to applicable law, you have the right to:

  • obtain a summary of the personal data we hold about you and how we process it;

  • have inaccurate or incomplete personal data corrected, completed or updated;

  • have your personal data erased where it is no longer needed or where you withdraw consent;

  • withdraw any consent you have given, as easily as you gave it, without affecting processing already carried out;

  • nominate another person to exercise your rights in the event of your death or incapacity;

  • have your grievances addressed by us.

If you are located in the European Economic Area, the United Kingdom or another region with similar laws, you may also have the right to object to or restrict processing, to receive your data in a portable format, and to complain to your local data protection authority.

To exercise any of these rights, contact us using the details in section 11. We may need to verify your identity before acting on a request. We will respond within 30 days. If you are not satisfied with our response, you may escalate your complaint to the Data Protection Board of India.

10. Other terms

Children. The Website is intended for business users and is not directed at anyone under 18. We do not knowingly collect personal data from children. If you believe a child has provided us with personal data, please contact us and we will delete it.

Third-party websites. The Website links to third-party websites, such as award and partner pages. We are not responsible for the privacy practices of those websites, and we encourage you to read their privacy policies.

Changes to this policy. We may update this policy from time to time. The "Last updated" date at the top shows when it was last revised. If we make material changes, we will post a notice on the Website.
